District 2 Issues:

Two controversial projects in District 2, Olde Towne returned to the Planning Commission for discussion on Thursday, June 22nd.

A project on Old Country Road between Dryer and College Avenue (clear cut in July 2005 and original request for 3 lots) was discussed. After meeting in executive session,  the project was approved  by the Planning Commission without a variance.  The property, which was comprised of 3 non-conforming lots of record, will be reconfigured into two lots. The new lots conform to the minimum square footage of R-1 requirements, but do not conform to the minimum requirement of 100' at the street.

The Via Dolorosa project on Captain O'Neal Drive (previously approved with a public road with 7 lots) was back for discussion with a request for a private road and 8 lots. The Commissioners discussed the city requirements for private roads (30' or 50' in width) and residents discussed concerns for FEMA debris pickup, garbage pickup, mail delivery, greenbelt between adjoining property and the maintenance of the Potter's Mill retention pond as part of the project.  The Commission vote was 5 for the project, 2 against and 1 abstention.  The request failed.  An subsequent request for a 50'private road and 8 lots was approved at the Planning Commission on July 27th.   The City will not provide garbage service on the private road, future homeowners will be required to petition the Post Office for mail service, rent PO boxes or install a bank of mail boxes on Captain O’Neal opposite the new development and FEMA will not provide debris removal on the private road. The 40' setback required from the street for R-1 zoning has been calculated to include the private which is not the intent of R-1 zoning.
